Chesterfield Borough Council Refuses New Licence For Bar Centro

The committee carefully considered the application for a new premises licence for Bar Centro on Holywell Street before reaching their decision.

Objections to the application were made by Derbyshire Police, the council's environmental health and licensing teams and by local residents.

The council adopted a special licensing policy in 2012 in relation to part of the town centre, including Holywell Street. This means a licence will be refused unless an applicant can demonstrate it will not add to crime and anti-social behaviour.

The committee felt the applicant, Shaun Noble, who was a business partner in Bar Centro before its licence was revoked earlier this year, had not demonstrated that enough steps were in place to prevent crime and disorder and public nuisance, meaning they had no choice but to refuse the application.

Councillor John Burrows, Chesterfield Borough Council's Leader and Executive Member for Regeneration, said: "The licensing committee must carefully consider each application for a licence on its own merits as they did in this case - but the fact that the special licensing policy applied and that the people making the application had previously been involved before its licence was revoked, meant they also had to take that into consideration.

"We treat the threat of anti-social behaviour seriously and the committee didn't feel enough steps had been put in place to prevent the drug dealing which had previously taken place at Bar Centro, or to stop crime and disorder in the street.

"There is already a large number of pubs and clubs in the area and the committee cannot grant a new licence if objections have been made - as in this case by the police, council officers and residents living nearby - unless the applicant can demonstrate that they will not be adding to existing problems in the area."

Mr Noble has the right to appeal the council's decision to the magistrates' court.

The bar's previous licence was suspended in December 2013 following a police operation which found evidence of drug dealing on the premises.

The licence was then removed by the council in January, with the decision upheld by magistrates in May.
