Chesterfield Borough Council Confirms Rights For Variable Hours Workers

Chesterfield Borough Council has passed a policy which confirms that staff on variable hours contracts will continue to have the same rights as other employees.

These rights include:

  • Holiday entitlement
  • Sick pay based on the number of hours worked in the previous 12 weeks
  • Access to training courses

The council's Employment and General Committee agreed the new policy developed with the unions UNISON, GMB and UNITE.

The policy provides that the number of staff employed on variable hours contracts will be reviewed regularly with input from the trade unions. 

Councillor Graham King, Chesterfield Borough Council's Executive Member for Governance and Organisational Development said: The council has not used staff in exploitative ways and this policy confirms this.Before taking on new staff on variable hours contracts, managers will be required to carry out a review to see if the post can instead be filled on a permanent contract basis.

"Due to the nature of the services we deliver, there is a need for us to offer some jobs on variable hours contracts - such as in leisure centres for fitness classes or in our theatres when they require extra staff at busy times, such as the pantomime season.

"Equally this suits many people who may be studying or have full or part-time work elsewhere who cannot commit to working a set number of hours each week."

"This is another example of the council's ability to deal with difficult problems through partnership working, this time with the trade unions."  

The policy also formally confirms the existing practice of ensuring that staff on variable hours contracts are free to find work elsewhere and offers guidance to managers on using variable hours staff to cover for planned staff leave or at times of staff sickness.
